Terms of Uses:

Please carefully read these terms and conditions. You acknowledge and agree and understand the terms that apply to you in these Terms of Use by using the service (as defined below). An agreement ("Agreement") between you and Zigzag Car Limited is formed by these Terms of Use.

Your use of the service provided by Zigzag is applicable to the terms of the Agreement. Please avoid using or continuing using the application or service if you do not agree to the Terms of Use.

 

The terms of the Agreement may be changed at any time by Zigzag car. Such changes will become effective once they are posted on https://www.zigzagcar.com/terms.html or the Application.

Zigzag Platform :

Zigzag Car is an online intercity ride sharing platform that connects drivers and passengers who need to travel on the same route and are willing to share the cost of the journey. Each driver posts the itinerary for a ride on the app, and interested co-travelers can book a seat. 

Zigzag Car is an amazing innovation aimed at solving boring travel; fuel expenses; trip cost; convenience of travel; inadequacy in mass transport & many more in Bangladesh.

To begin with, Zigzag Car is a neat app (platform) where the car owner offers to share his city to city (long distance) ride with anyone who wants to join for a price.

The app charges a fee to connect the co-traveler (the person who joins the ride) and the car owner/driver (the person who offers the ride).

The ride begins with the car owner/driver picking up the co-traveller from the pickup point. At the end of the trip, drops off at the destination and finally receives the payment (cash). 

Users may start using the App in accordance with these Terms after downloading the App, approving the mobile phone number and completing the registration  required fields . The app is available free of charge.
 

Registration & Account Creation

The terms and conditions of this agreement may be changed at any time, and Zigzag Car reserves the right to do so. You will only be bound by the modified agreement if you agree to it. Zigzag Car reserves the right to update any information on pages referred to in hyperlinks from this agreement at any time, and such updates shall take effect immediately upon posting. You will be deemed to have agreed to any such changes if you continue to use the Zigzag car platform or rideshare services after any such changes.

 

Conditions of registration on the platform :

 

Each user must register for a user account in order to access the Zigzag car platform. Zigzag Car has the right to terminate any additional or duplicate accounts. Each user may only create one user account. Additional eligibility requirements may apply to your participation in specific Zigzag car programs and usage of specific Zigzag car services, as determined by Zigzag Car.

 

People must be at least 18 years old to use the platform. Minors are not allowed to register on the platform in any way. You represent and warrant that you are at least 18 years old by accessing, using, or registering on the platform.

The platform gives members the opportunity to publish posts on the platform, view posts, and communicate with one another to reserve a seat. If you are not logged into the platform, you may still view the advertisements. However, you must first register as a user and create an account before you can post on the Zigzag platform or book a seat.

Verification :

In order to enhance accuracy, promote transparency, and prevent or detect fraud, Zigzag has established a system to verify some of the information you provide in your profile. These situations essentially include when you enter your phone number or provide us with an identity document. All your information will be kept confidential by Zigzag car.

 

Requirements for Drivers: 

  • You must be at least 18 years old.

  • You have a current and valid driver’s licence.

  • You are the owner of all the insurance coverage necessary by law to drive a car in the state, county, or country where your vehicle is registered.

  • You carry liability insurance that covers bodily injury to all occupants of your vehicle.

  • You have no record of major driving offence convictions.

  • You are medically fit to act as a Driver.

  • You have volunteered to be a driver and have not been designated by a group or company as a driver and receive no compensation from a group or company for driving.

  • You are an independent party participating, with others, in a voluntary, not for profit, ridesharing arrangement.

  • You follow the prescribed manufacturer's preventative and maintenance standards for the vehicle you use.

 

It is important for users to confirm with their insurance provider if carpooling and ridesharing are covered before proceeding. You must contact us straight away if you ever cease to fulfil the eligibility standards outlined in this section, failing which you will not be permitted to use the Zigzag car service. For any reason or no reason at all, Zigzag Car maintains the right to reject or limit access to the Zigzag Service to anybody. 

 

Charges:

As a passenger, you are aware that placing a request for or using carpool services may incur charges for you. The decision to set and adjust prices is under the authority of Zigzag Car. The type of service you request as well as the associated pricing may vary. Regardless of whether you are aware of the charges or their amounts, you are responsible for evaluating the applicable price quote inside the Zigzag App and for all charges incurred under your user account.

Fares:

As a passenger, you have to book your ride through the zigzag app. You have to pay the “Service Charge” in advance. You have to pay the service charge in advance while booking the ride, and you pay the remaining amount to the driver at the end of the ride.

Ride Fare For Passenger :  

If you are the first passenger, then you will see the estimated fare range for the entire ride while booking the ride, as no other passenger has booked the ride yet. When the second passenger books the ride, the ride fare will be split between the two passengers. Your ride cost will be reduced automatically if any other passenger shares the ride with you. The passenger who books the ride will be responsible for the entire ride.

 

Service Fee :

You will be charged a “Service Fee” for each ride. We charge 10 % commission from the ride charge, including 15% vat. You have to pay this charge in advance through the zigzag app to book a ride.

Cancellation fee : 

Once you've requested a ride, you can cancel it using the Zigzag App, although in certain situations, there will be a cancellation fee as per the Zigzag car company's policy. You can also incur fees for failing to show up after calling for a ride.

Damage Fee:

You agree to provide a "Damage Fee" of up to 100-2000 BDT toward car repair or cleaning if a driver claims you have substantially damaged the Driver's vehicle. The damage fee will depend on the severity of the damage. Prior to collecting the damage fee, Zigzag Car reserves the right (but is not required to) to confirm or otherwise request evidence of damages.

Processing Transactions:

All Charges are processed through a third-party payment processor. Without giving you advance notification, Zigzag Car may switch to a different third-party payment processor. Only the Zigzag Platform shall be used to process charges. Your duty to make payments for using the Zigzag Platform and Rideshare Services is satisfied by your payment of Charges to Zigzag. Based on the payment frequency specified in your options, certain Charges may be invoiced to your chosen payment method as a single purchase transaction. Check your payment history and ride receipts if you don't recognize a transaction.

 

Coupons :

Upon finishing a ride, you can be given coupons you can use to pay for certain fees. Except as required by law, coupons are only good for use on the Zigzag Platform and cannot be transferred or exchanged for cash. Unless otherwise stated, coupons cannot be combined, and if the cost of your ride exceeds the value of the appropriate credit or discount, we will charge the balance to the payment method on file. Before applying the voucher to any quoted or purchased tickets, Zigzag may deduct any applicable service fees or other charges. Additional restrictions on coupons may apply as stated in a relevant offer or by clicking on the relevant coupon under the Promotions area.


 

Payment System:

Zigzag may require permission for your chosen payment method each time you request a ride or if a new payment method is added. This is done to validate the payment method, make sure the cost of the ride will be covered, and protect against fraudulent activity. The permission does not result in a charge, but it may limit the amount of credit you have available up to the next processing cycle at your bank. 

Cancellations and Refund Charge:

In accordance with Zigzag cancellation policy, you are free to choose to cancel your request for transportation services from a Third Party Party Provider at any time before the Third Party Provider arrives. You as a driver can cancel your ride as long as no passenger has booked the ride. Once a passenger booked your ride, you can no longer cancel the ride. As a passenger you can cancel the ride from the time you booked the ride up to 24 hours before the start of the ride. In this event, you could be charged a fee. If you cancel the ride within 24 hours then you will get a full refund but if you cancel the ride after 24 hours of booking then you will get a 50% refund. You shall be entitled to a refund for any fees paid if the transportation services are cancelled for any reason not attributable to you in line with the cancellation policy of Zigzag. Customers will receive their refund money in accordance with the company's policy within 7 to 10 working days.

 

User Ratings & Feedback:

Users who have enjoyed a trip together may provide reviews and/or ratings for the other users. Users that leave feedback should make sure that it is truthful and accurate. You consent to our posting user reviews of you on your profile. Zigzag doesn't always follow up on user reviews and ratings. In addition to disclaiming any responsibility for user comments, Zigzag has the right to edit or remove any user feedback that it judges, in its sole discretion, to be inappropriate.

User Disputes:

Any actual interactions you may have with other Users of the Zigzag Service are not the subject of our involvement, and we are not in any way liable for them. We will not participate in any discussions or negotiations involving issues between Users. We strongly advise you to notify the appropriate local authority of any problems you have with other users.



Behavior of App Users:

Commitment of all visitors to the App:

Regarding what constitutes appropriate usage of the Zigzag Service, we hold the last say. As necessary to guarantee appropriate usage, we retain the right to modify, remove, or deactivate any User's account or information without incurring any duty to third parties and without prior notice. If we think that you have used the Zigzag Service fraudulently or if you have participated in any other behaviour that we feel violates our terms of use or the privacy policy for the Zigzag Service, we reserve the right to suspend or delete your account and take actions according to the general law.

 

You must not:

 

  • Damage, disable, overburden, or impair the Zigzag Service (or any network connected to the Zigzag Service); 

  • resell or redistribute the Zigzag Service, Zigzag Software, or any part of it; 

  • use any unauthorised forms to modify, reroute, or gain access to the Zigzag Service; 

  • damage or interfere with another User's ( Zigzag User) device and software ; or illegally access software or bypass;

  • Deliberately mislead other users by supplying false information.

 

Additionally, you acknowledge that you will not use the Zigzag Service in any way to: upload, post, transmit, transfer, distribute, or facilitate the distribution of any content (including text, images, sound, video, data, information, or software) :

 

  • Interfere with another user's right to privacy; 

  • harass, slander, intimidate, or threaten another user, person, or organisation; distribute chain letters, surveys, or competitions;

  • Post any offensive, obscene, or defamatory content;

  • Post any trademarks, logos, or other intellectual property without the owner's consent;

  • Post any content (such as a virus, worm, or Trojan horse) that might harm a computer's functionality; 

  • advertise or sell any products or services.

 

Driver Engagement:

When you use the App as a Driver, you commit to:

  • Abide by all laws, rules, and ordinances pertaining to driving and operating a vehicle, especially the requirement to have valid driving privileges and to have civil liability insurance at the time of the journey;

  • Verify that your insurance coverage includes shared trips and that the passengers you travel with are treated as third parties in your car and are therefore protected by your insurance.

  • Avoid taking risks when driving and refrain from using any substances that could impair your attention span or impair your capacity to drive defensively and carefully;

  • Publish announcements that only apply to routes that are approved by zigzag car limited.

  • Follow the Route as described in the Announcement, particularly in regards to whether or not to utilise the highway, and to observe the times and locations set with the other Users, particularly the meeting spot and the destination;

  • Not carry more passengers than the advertised number of seats;

  • Drive a vehicle that is in excellent condition and conforms with all applicable laws;

  • To provide your driver's licence, car registration certificate, insurance policy, and any other document that indicates your capability to operate the vehicle as a driver in the App to Zigzag or any passenger who asks for it;

 

Passenger engagement

When you use the App as a Passenger, you commit to:

  • Behave properly during the trip so as not to distract the driver's focus or driving or the other passengers' peace and quiet; 

  • Respect the driver's vehicle and its cleanliness; 

  • Notify the driver immediately in the case of a delay; 

  • Wait for the driver at the agreed meeting point until at least 30 minutes after the agreed time; and 

  • Provide Hoop, or any driver who requests it, with your identity documents or any other relevant information.

  • Prevent from bringing anything that might impair the driver's focus or ability to drive safely, or whose nature, ownership, or transportation is prohibited;

  • Keep a valid document proving your identity and your right to cross the border on hand and make it available to the driver and any authority who requests it for a transboundary journey; 

  • Make sure Drivers can reach you at the phone number listed in your profile, including at the meeting location.

If the person for whose benefit you reserved the seat violates these General Terms and Conditions, Zigzag retains the right to suspend your account, restrict your access to the services, or cancel these General Terms and Conditions.

 

Personal Information

You acknowledge that disclosing personal information, such as addresses and contact details, is a decision that might have an impact on your personal security. You recognize that sharing such information with anybody, including those you might encounter through services like this, necessitates caution and that appropriate precautions must be taken to ensure my safety and the security of my personal information. You are aware that changes to the program are published by Zigzag using both online and offline media. Zigzag will contact you on a regular basis by phone, email, or both to ask you to utilise the service and to assist in connecting you with individuals who are in the region of your tours.

Termination Term

When you use the App as a Passenger, you commit to:
